1. Introduction
Welcome to Café Cal (“App”), a nutrition and wellness tracking application developed and operated by Café Cal (“we,” “us,” or “our”). Café Cal helps you log meals, track nutritional intake, monitor weight and water intake, record exercise, maintain streaks, store food photos, and connect with Apple HealthKit.
These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you” or “user”) and Café Cal governing your access to and use of the App, including any related features, content, and subscription services offered through the Apple App Store.
2. Acceptance of Terms
By downloading, installing, or using Café Cal, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated by reference.
You accept these Terms when you:
- Download or install the App from the Apple App Store
- Create an account or sign in (via email, Google, or Apple Sign-In)
- Access or use any feature of the App
If you do not agree to these Terms, you must not use the App.
Eligibility
To use Café Cal, you must:
- Be at least 13 years of age. If you are between 13 and 18, you confirm that your parent or legal guardian has reviewed and consented to these Terms.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the App under any applicable law.
3. User Accounts
Creating an Account
You may register using email/password, Google Sign-In, or Sign in with Apple. By creating an account, you confirm that the information you provide is accurate and up to date, and that the account is for your own personal use.
Keeping Your Account Secure
You are responsible for keeping your login credentials confidential. Do not share your account with others or use another person’s account. If you believe your account has been compromised, notify us immediately at inandha97@gmail.com. We are not liable for any loss arising from unauthorized access caused by your failure to keep credentials secure.
Account Deletion
You may delete your account at any time from Settings within the app. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in harmful conduct, or provide false information.
4. User Conduct
By using Café Cal, you agree to use the app only for its intended purpose. You must not:
- Use the app for any unlawful purpose
- Impersonate any person or entity
- Attempt to access, tamper with, or disrupt our servers or infrastructure
- Introduce viruses, malware, or harmful code
- Use automated tools (bots, scrapers) to access the app or its data
- Reverse engineer, decompile, or disassemble the app
- Upload content that is illegal, obscene, defamatory, or infringes on the rights of others
Your Content
You retain ownership of content you upload (photos, meal data). By uploading, you grant us a limited, non-exclusive, royalty-free license to store and display it as necessary to operate the service. This license ends when you delete your content or close your account. You are solely responsible for ensuring your content does not violate any third-party rights.
5. Subscriptions and Payments
Café Cal offers auto-renewable premium subscriptions (“Café Cal Premium”) managed entirely through Apple’s App Store. A subscription unlocks the app’s full functionality.
Subscription Plans
Café Cal Premium is offered on the following auto-renewing plans:
- Monthly — billed every 1 month.
- Quarterly — billed every 3 months, and includes a 7-day free trial for new subscribers.
- Yearly — billed every 12 months, and includes a 7-day free trial for new subscribers.
Prices are shown in your local currency on the subscription screen inside the app and on the App Store before you purchase, and vary by region. Any unused portion of a free trial period is forfeited when you purchase a subscription.
Billing and Auto-Renewal
Subscription fees are billed to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew at the same price for the same period unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
Cancellation
You may cancel your subscription or turn off auto-renewal at any time through your Apple ID settings:
- Open Settings on your iPhone
- Tap your name, then Subscriptions
- Select Café Cal and tap Cancel Subscription
Cancellation takes effect at the end of your current billing period. You retain access to premium features until that date.
Refunds
All refund requests are handled exclusively by Apple at reportaproblem.apple.com. Café Cal does not issue refunds directly.
Price Changes
We may update subscription pricing from time to time. Apple will notify you in advance of any price changes in accordance with App Store policies. If you do not agree to a price change, you may cancel before it takes effect.
6. Intellectual Property
Café Cal and all its content, features, and functionality — including design, graphics, text, logos, and software — are owned by us and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the app without our written permission.
You retain full ownership of your content. We do not claim ownership of your photos, meal data, or personal information.
7. Disclaimer of Warranties
Café Cal is provided on an “as is” and “as available” basis, without warranties of any kind. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Not Medical or Dietary Advice
Café Cal is not a medical device and does not provide medical, clinical, or professional dietary advice. Nutritional estimates generated by AI analysis (Gemini API) and food databases are approximate and may not be accurate. Nothing in the app should be interpreted as a diagnosis, treatment recommendation, or substitute for advice from a qualified healthcare provider or registered dietitian.
HealthKit Data
Data read from or written to Apple HealthKit is for general informational and tracking purposes only. We do not independently verify the accuracy of HealthKit data.
Service Availability
We do not guarantee that the app will be available at all times, uninterrupted, or free of errors. We may modify, suspend, or discontinue any part of the app at any time.
8. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Café Cal, including but not limited to:
- Reliance on inaccurate nutritional or calorie estimates
- Health outcomes resulting from dietary decisions made using the app
- Loss of data, including meal logs or health records
- Unauthorized access to your account
Our total cumulative liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event, or (b) USD $10.00.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the above limitations apply only to the minimum extent permitted by law.
9. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive activity, or use the app in a way that could harm others.
Upon termination:
- Account data stored in Firebase will be deleted per our Privacy Policy
- Data written to Apple HealthKit remains governed by Apple’s terms
- Locally cached data is removed when you uninstall the app

10. Third-Party Services
Café Cal integrates with third-party services subject to their own terms:

We do not control these services and are not responsible for their availability or practices. If a third-party service becomes unavailable, we may modify or remove the relevant feature.
11. Dispute Resolution
Informal Resolution First. If you have a dispute, contact us at inandha97@gmail.com and give us at least 30 days to resolve it informally before initiating formal proceedings.
Binding Arbitration. If informal resolution fails, disputes shall be resolved by binding individual arbitration rather than in court.
No Class Actions. You agree to resolve disputes only on an individual basis and waive any right to participate in a class action or representative proceeding.
Opt-Out. You may opt out of the arbitration clause by emailing us with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms.
12. Indemnification
You agree to defend, indemnify, and hold harmless Café Cal and its owners, officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the app, violation of these Terms, or violation of any applicable law or third-party rights.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, and the courts of Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, without regard to conflict-of-law principles.
14. Severability
If any provision of these Terms is found unlawful or unenforceable, it will be severed without affecting the remaining provisions. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Café Cal.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you via in-app notification at least 14 days before changes take effect. Continued use after changes constitutes acceptance. If you disagree, you must stop using the app.
